Shoplifting, Larceny, Robbery, Theft Larceny

Hello. I got caught shoplifting at AFEES overseas in Okinawa japan. I was charged with larceny. I am a dependent, but since i had a job through mccs they charged me as a civilian. In Okinawa they do not have a jurisdiction for civilians, so it goes through KDAP ( Kadena disciplinary action program) . Very stupid of me, regret doing it. Loss prevention stopped at the door and asked me to go with them. I cooperated gave them what I had took, and they called MP's. MP's came, cuffed me and took me into the station. Sat me in a room, and read me rights had me sign a few papers and that was all. No fingerprints. I was released and told to wait for KDAP to call to see what my punishment would be, ( community service, counseling, etc) I received the civil demand letter through mail from AFEES, paid the fee (400$) and that was all. I was let go from my job, and I am wondering if this will go on my background record for future jobs. When I was in the process of the checkout from my job, I was told that if I were to apply to another job and if they asked if I was convicted of something to say no. But to say yes if i was arrested or charged with something. I just want to know if this will stay on my record forever or is there a way I can get rid of it. I am from California and I go back to the states in a couple months. I appreciate any information and advice.

You MIGHT be ordered (your sponsor will be ordered) to return to CONUS.

You will also have to address the theft allegations via the court process, if you are formally charged.

You might also have your PX privileges and commissary privileges taken or suspended.

The outcome depends upon the nature of the charge, the amount alleged stolen, your prior criminal history, etc...

You should plead NOT guilty and consult with a lawyer, or ask the court if you qualify for any 1st time offender diversionary programs, and if you qualify for a court appointed attorney.

Until then, keep your mouth closed about the ALLEGATION.

Speak ONLY to your lawyer when you get one.

Potential employers have a way of discovering your criminal history, unless the matter isn't processed by the court.

Right now you need to work on getting the charge into a diversionary program for 1st time offenders.

If it is handled by the court, yes it will follow you until you die.

The advice given was spot on by your former employer, heed it!

The time to ask these questions is before you do stupid shit, mate.

Would've been nice if the OP had mentioned that, and that being the case, I suspect the OP should consult with a JAG attorney (or some local attorney who understands the program and how it is administered).

To be fair, the OP did mention it by mentioning the specific program.

I did get a paper from MP's saying i can't shop on kadena Air Force base until the KDAP hearing. They told me that is all the I'm getting from MP's. KDAP can possibly barre me from kadena base, make me do community service, or counseling etc. MP's told me I am not going to court because they don't have one overseas.


Also, it is my first offense. The amount I took was under $500.


I did get a paper from MP's saying i can't shop on kadena Air Force base until the KDAP hearing. They told me that is all the I'm getting from MP's. KDAP can possibly barre me from kadena base, make me do community service, or counseling etc. MP's told me I am not going to court because they don't have one overseas.

My GUESS is that you'll walk away unscathed, as long as you make sure you do EVERYTHING required to clear this mess up.

Take it step by step and in the very near future, you'll be able to look back at this incident and be equipped to never do anything stupid again!

I feel real stupid for doing this. Lesson learned. I just want to know if this will go on criminal record. My job told me it will, but then MP's told me they don't it will. I'm just confused. I wasn't convicted of anything, but was arrested and charged with larceny.

You'll just have to ride the storm out.

As you've seen, you received two differing answers.

The MPs can't legally arrest civilians.

MPs can only detain civilians.

Kadena appears NOT to have a branch of a federal district court, nor does any US Magistrate sit there.

My GUESS is this incident will not be treated as a CRIMINAL OFFENSE.

Please be patient and complete all tasks assigned to you and this event will disappear.

How long did you have to wait for the hearing? Going through a similar case.
