Something fishy going on. Mediation was first week of May.
Supposed to have two checks from both insurances.
On May 20: Your checks arrived this morning via legal messenger.
I cannot deposit them until I have the releases signed. Once you come and sign the releases, I will deposit the checks and then they will take about 5-10 business days to clear and I can disburse the funds.
I signed a release documents on May 22.
I was promised that will receive a settlement check from my lawyer in 10 days or so because "they are ready to send it just waiting for a release documents".
No emails from a lawyer since.
My email on June 10 asking where is my check.
Respond next day - she did not receive the check.
Respond June 13: I spoke with ***'s assistant and she claims fault. She said it sat on her task list and she didn't get it mailed out until yesterday. It is on its way to us. ...
Respond June 14: We received the check today. My book-keeper will be in on Monday to deposit the check. It needs to stay in the account until it clears. I believe we can probably give it to you late next week or early the week after.
I made it clear that I am not satisfied why it takes so long, and why it was not checked on time. and I am not willing to wait that long because it is now ruin my vacation plans.
Respond from a lawyer:
I had received the check from Allstate but not the check from Liberty Mutual. I kept you updated regarding the check from Liberty Mutual (WHICH IS NOT CORRECT UNTIL I HAD TO ASK MYSELF) and therefore you knew that we did not have both checks..... I am sorry but I have to follow the rules of the bar association in regards to check disbursal. I did not have anything to do with Liberty Mutual not sending the check to us. (????!!!!! isn't she my lawyer to keep truck on everything?!)
I followed up numerous times and provided you with an update (WRONG. No response until June 12 after my reminder).
My last email was asking her to prepare the check end of next week as latest.
No respond. If I even receive the check by June 22 - 26, it is already way too long.
If the check deposited on June 17, why to wait another week to "clear" it?
I requested a copy of both settlement checks a day ago, but no respond yet.
I had no luck calling to Liberty and log in online to see when my check was send, they refused to give me any info because I have a lawyer.
It is frustrating for me.
Please advice.
What is the best way to check when my check was send and if there is a misusing my settlement check for one month issue. If my lawyer is honest with me and just "forget" to check everything on time, do I have a right for compensation from Liberty?
Thank you for understanding.
Sincerely
