Took my car to get an oil change done and this is the Walmart that I worked for not only have they mess up on my car once but two additional time meaning the first time we forgot to take the seal out when they did the oil change they put the oil in my car and it leaked out so I had to get another oil change the second time is a forgot to put the air hose back onto my car so I can't my car dying and 1/3 being the last time I got an oil change from them they did not put no oil in my car and now there's metal shavings in my oil tank I talk to claims and they said they were into their investigation the claims guy called me back and said that Walmart not at fault and they did an oil change and I asked him did you see him put oil in my car and he said I seen them do an oil change so that's still not answering Mike direct question the guy hung up on me and now I am talking to the Bureau of Automotive Repair and waiting for them to do there investigation and to call me back my car now is running really rough I have metal shavings in my oil tank my car is not the same at all it's a 2010 Toyota Venza I've only had it for 3 years never had a problem until I took it there I don't know what I'm supposed to do now because they also lied and said that I didn't come back for those additional check ups whenever they messed up my car and I had the kid print up every receipt that I have had through there getting my oil change and there was only 6 so I went through my papers and found an additional receipt showing for one of the previous oil checks that they had to do because there was no oil in my car has it leaked out so I have proof that the manager lied to the claims person I am so stuck because the manager that I spoke to his my old manager and he told me that nobody ever wins these cases against Walmart so what is the next step that I need to do I need a lawyer to help me

I have to wonder why you would keep going to a shop where you were getting lousy results.... but that doesn't matter, the damage is done.

It sounds to me as if you have an oil leak. Walmart may have done the oil change, but the oil leaked out afterward. Is the bottom of the engine very oily?

If so, this likely isn't Walmart's problem. you are responsible for maintaining the vehicle and making sure it has oil every time before you drive it.

I suspect even now you are still driving it while there are metal shavings in the oil, likely causing more damage.

Your engine needs more than an oil change now. The metal shavings are likely from the camshaft or crankshaft bearings, which will be a very expensive repair.

You are going to have to be able to proof that walmart was negligent and failed to do something if you will get anywhere with your complaint. After the oil change did you pop the hood and check the condition and level of the oil? If not, you likely can't prove they did not change the oil. You can not prove that it didn't leak out due to other problems with the engine.

In short, even if they did something wrong, you likely can't prove it at this point and it is not worth pursuing. Maybe focus on repairing and selling the vehicle before it becomes a bigger problem.

Well for one because I used to work there and the one person that did work on my car that did do it right I thought was going to be the one that was working on my car at the time so being said that I work there and I know the people there there shouldn't have been no problems and no there's no oil leak at all I even went under the car with the people at Walmart just even check to see to make sure there was no leaks there is no leak at all the blue Powder stuff that Walmart puts around your still was still there there's no leaking it's just as if my oil disappeared out of nowhere as if they never completed the oil change and I rode around for the rest of this time with that little bit of oil that I had left before they did an oil change they said and whatever oil is left burned and now it is messed up my carcompletely

I do have proof I have the receipts to show the proof that every other time I've had an oil change there has been no problems at all whatsoever this car is brand new and I've only had it for 3 years I keep my car will maintain and I keep all my receipts not only did that happen but my old manager lie to the claims person and told them that prior to this incident the first time I had to go back for them to redo my oil change because they messed up he told them that he does not know what I'm talking about no manager knows what I'm talking about he has no idea but he was the one to approve of the guy to redo my oil change and it took me some time to go to my stuff but I found my receipt and all my order form receipt whenever you may call it it shows that I came in for them to check my oil because it had leaked out due to the fact that they put a seal on top of another seal and it drained out all of my oil so not only is he a liar but he lied to and nothing was wrong with it because I have to go purchase and have somebody help me put the oil in my car because he would not help me so there would be no reason for me to buy oil for my car if there was already a oil in my vehicle

Also, if you have continued to drive the vehicle, you have essentially erased any chance you had of holding Walmart responsible.
The car is not brand new if you have had it three years.
Your best option is likely to sell it.

In any future posts, please make an effort to use something that resembles proper capitalization and punctuation. Doing so will make it easier for others to read and understand what you write. After suffering through your initial post, I didn't even try to read your follow up.

not only have they mess up on my car once but two additional time

And yet you kept taking it there...?

we forgot to take the seal out when they did the oil change

We?? What seal? An oil change involves three things: (1) draining the existing oil; (2) changing the oil filter; and (3) refilling the oil. There's no "seal" that needs to be taken out of anything at any point. Also, does your use of "we" mean that you participated in this oil change?

the second time is a forgot to put the air hose back onto my car

Air hose? Is this something that had to be moved in order to access the oil filter? If not, why would anyone move or remove an air hose during an oil change?

my car now is running really rough I have metal shavings in my oil tank

Why would you drive the car if this condition is known to you?

do I need a lawyer to help me

You need a mechanic to fix your car. You can then sue -- probably in small claims court. Lawyers are not allowed in California small claims courts.

First off it's called talk text okay sorry that I did not pre proof read my statement before I submitted it to this site anywho no I did not participate in the oil change and if you don't know what an air hose is it's the thing that hooks back up to your engine that makes your car go and if they do not clap your hoes back on there then it makes your car stall out and die because your engine is, sucking up air third I already told you why I brought it back there because it was my old place of business and I figured my friend was going to do my oil change there that I trusted but come to find out afterwards I found out he no longer works there and the seal that steals your oil tank that is what I am talking about so instead of making sure that the seal was out completely of my car to drain the oil they put another seal on top of a seal that was cracked

I have my oil from the oil change that a different place did on my car after the fact Walmart claim to do one I also have my oil filter that shows little pieces of metal shavings and again the reason being that I have to drive my vehicle is because that is my only means of transportation with three children excuse me I'm not rich like many of you on here but that is my only way of getting from point A to point B and you're really kind of rude you know that

Not trying to be rude-just being honest.

Those metal shavings are likely from your bearings. The sooner you unload this car the better off you will be.

You aren't going to get anywhere trying to sue anyone over this. If there ever was a chance it passed a long time ago.

Call it whatever you want. If you can't write in a manner that allows others to easily read what you write, don't be surprised if you get bad answers. Garbage in, garbage out, and I won't waste time with someone who can't be bothered to try and communicate clearly..

Thank you

Also, I'd be very careful about using words like "lied" unless you have proof. I don't mean proof that there was no oil; I mean proof that he knew there was no oil and said there was anyway. "Made a mistake" is as likely and possibly more likely than "deliberately sent out a car with no oil in it", particularly when there is evidence that the oil may have been there initially and leaked out.

Thank you but we did make sure that there was no oil leak in fact we looked when we were at Walmart we went underneath the car and looked ourselves with the managers and there is no oil leak

The responsibility will still fall on you.

Hardly anyone ever does this (I certainly don't), but it is the responsibility of the driver of the vehicle to inspect it and make sure the vehicle is serviceable EVERY TIME before driving it.

After you received the service, and before driving away, you should have checked the oil. At minimum you have a shared responsibility. You have greatly harmed your chances of success with this complaint by continuing to drive the vehicle.

Your time and money might be better spent repairing the vehicle and selling it.
