File for disability

In 2015 on July 6th I had a stroke. My left arm, hand, and leg were paralyzed for awhile due to this. I have limited use in my left arm, hand, and leg now. I have to use a cane to walk now. I also have speech issues as well from this stroke. On August 26th of 2015 I also had another stroke. That causes my energy levels to fluctuate on a daily basis even with medication.

I haven't filed for disability for this yet. I hoped to make a fully recovery, but that goal isn't even close yet. Ever since my first stroke I've had to live with my parents again, and I've spent what money I've had saved up since this happened.

Would a lawyer be able to file for me initially for disability? Would one take monthly payments for this if I was able to get it without waiting months? With me seeing a nurse practitioner rather than a doctor complicate things with this? I have an issue with the doctor since he discharged me twice from the hospital and I ended up going to another hospital the next day in a rescue squad. I did everything in my power to get into the ER with plenty of time to be injected with tPA, and was discharged with an appointment to see the doctor/neurologist in a month. If I was given that injection it's possible I would of just ended up with minor damage from this. That's the main reason why I see the nurse for my stroke.

You don't need an attorney to file for disability.

However, most attorneys don't require you to pay upfront.

Most attorneys will take their fee out of your award.

Social security limits the fee the lawyer receives.

See a couple lawyers tomorrow, most will start the case after a telephone interview.

Thanks for the reply army judge.

I would just rather have an attorney do this for me. I don't have any experience with something like this, so I'm sure I would screw something up.

Over the weekend I filled out forms on websites at a couple firms kind of local to me that say they specialize in this. Hopefully one or both of them get back to me on Tuesday. Is there anything that I should lookout for when choosing a firm to do this for me?

Yes, make sure you obtain a signed (then you sign) a written retainer.
The retainer describes what the attorney will do, and how much it will cost, as well as if its taken on a contingency (when you get paid, the lawyer gets paid).

OneFootIn, in addition to obtaining an attorney for your case, I HIGHLY recommend that you begin to educate yourself on the SSDI application process, the steps involved, etc., etc., so you are not "in the dark" on what your attorney is or is not doing. With the opportunity to get on the internet, you have access to the mainl policy manual that ALL the SSA, DDS and ODAR caseworkers & managers reference. It is called POMS and you can access it from SSA's main website, the .gov website. I cannot emphasize enough how important it is for you to keep "in the loop" on what's going on. You are putting your faith & future in the hands of a stranger (an atty.) so be wise!

ps:get your application started yourself, right now, online from SSA's website! Even if you just partially fill out the first page or so, then read through briefly to the last pages, it WILL be considered submitted as of that date. Your reason for not completing all questions on the app is simple, you need help filling it out because you don't fully understand what or how to do it.
Good Luck!

Hi lizzyb222,

I ended up getting rid of the attorney I had for this a couple weeks ago. They ended up being a complete joke. They didn't do a single thing yet for me that they said they would before my meeting.

I've been reading that manual for a few days now. I've also been filling out the application online the best that I can. I go for my meeting Monday morning.
