We dropped off our 1974 BMW 2002 tii to Washington Auto in MA over 5 years ago. The owner continuously tells us that it will be done, but it is still in pieces. I would like to take the car out of his shop. What are my legal rights? Although it's in pieces, I'd like him to put it back together as-is before I pick it up.

Unfortunately, my husband dropped the car of with a hand shake so we have absolutely no paperwork. We did, however, have AAA drop the car off at his shop 5 years ago, so we could probably get that detailed info.

Please let me know what next steps I should take.
 
First step is to ask them to reassemble the vehicle so you can pick it up.
If a restoration was being done reassembly may not be a wise thing to do depending on what was being done and the stage it is at.
I would worry greatly that parts are missing after so long.

I'm just going to stop right here. You dropped off your car with an auto repair shop (I'm guessing) five years ago and never got it back? I can't even conceive of leaving a car in a repair shop five weeks, much less five years. What the heck have you been doing all this time?

I don't know how much this 43 year old car might be worth (especially since it apparently was in need of major repair), but I have a hard time believing it's over the small claims limit, so I suggest small claims court, although it's entirely likely that so much time has passed that the applicable statute of limitations has expired.
