Very Important Question

So we recently lost our house so my husband's uncle and girl friend allowed us to come stay with them. We have a verbal agreement that we could stay until we found a place and that we would pay $300 a month and buy our own groceries. We had only been living here 5 days when we paid the $300 and bought groceries. Well his uncle is schizophrenic and apparently thinks my husband is trying to sleep with his girl friend, so we noticed they started acting distant and complaining about everything... Well the day after we pay his girl friend rent cause she owns the house, I wake up and they are gone but I have a message saying we have till the end of the week to find some where else. We have no family, all the shelters booked with waiting lists... We have no where to go... Can she legally do that or what steps does she have to Take? We haven't done anything wrong, we have respected all her wishes. She basically said we have to leave because My husband's uncle is going to leave her if we don't... I'm just wondering what legal actions she has to take before she can actually MAKE us leave. We have a 9 month old and can't be out on the streets with him.
 
Legally she'll have to evict you by going to court.
That takes 6-8 weeks to actually occur.
However, that doesn't mean the crazy uncle won't eventually turn violent.
I suggest you make a deal.
Talk to her, ask her if you can at least stay three more weeks.
Otherwise, if she does go to court, you'll ALL be evicted.
 
The problem is we have no where else to go... We don't have family an be shelters are full. That's the only reason we can't just leave when she asked. His uncle is abusive to her so I'm not sure why she's even choosing him over us

Does that mean you have nowhere to go "this week" or nowhere to go "ever"?

The reason I put it that way is because, even if your $300 payment can be construed as buying you a month's rent, you will eventually be evicted and have to find another place to live anyway.

Apparently the homeowner, girlfriend and current squeeze of the crazy uncle, doesn't seem to care.

Realistically, she doesn't care about your problems.

She wants you gone.

As I suggested, approach her, talk with her, see if she will allow you MORE time.

Promise her you'll follow her rules while you stay in her home, and apologize to her for any distress this caused her.

You can then say, you are upset because your life is hard without a place to call your own.
Tell her you're struggling and appreciate her taking you in when no one else cared.

Be nice, polite contrite, and calm.

If you want to stay in the home of another, obey their rules.
 
As of right now we don't have any where else.


You can say that 1,000,000 times.
The law is clear.
If she wants you gone, you'll be gone.
Your problem isn't her problem.
That is why I suggested you talk to her, apologize, and obey her rules.
As it stands, you might be gone before the customary 6-8 weeks.
Its Not her worry that you have nowhere to go.
That is YOUR problem, not hers.
 
I Understand. We Haven't Disrespected Her Or Disobeyed Her Rules... We Are Currently Looking And She Allowed Another Month With A Raising Of $150 More For Rent.
 
$450 for rent is still pretty cheap.

Right now what you have in Georgia is a "tenancy at will" (a month to month lease). This can be terminated by your "landlord" with a 60 day written notice. And quite honestly they need to provide you the same amount of notice to increase this rent from the original $300; however, it doesn't appear that there's much legal business going on with this entire mess.

IF you're paying your rent the court will see no legal reason to evict you unless the landlord has provided this notice to move out and you haven't done so after the 60 days.

In my local craigslist there are always folks advertising rooms for rent. You might want to look at this site.

I Have Been Looking. No There's Never Been A Written Notice Given To Us. Just A Message On Facebook From His Crazy Uncle Cussing Us Like A Dog And Saying We Had To Be Out By Weekend. We Are Continuing To Look Though. Thank You :)
