Reading up on statutory rape, I've learned every case is different and they all have their own circumstances letting us know- Is this statutory rape? I obviously cannot find a case like the one I've got in mind and I really want to know about the legal basis of it. I would like to make it clear that the case has NOTHING to do with me, so I can't do much, but I would like to know other people's opinions nonetheless. This happened to a close friend of mine years ago when she was only eleven. Some kid, either 14 or 15 convinced her to have sex with him. She told me she didn't want it but didn't do anything to stop him either. Is this in any way illegal? Is it fair to say she was molested/assaulted/raped,etc.? It's difficult for me to say because they were both minors at the time. Also rape is defined differently in each state. This happened in New Jersey though. Any clarifications for me? Please?

Had an 11 year old child reported the sexual assault to her parents, most parents would involve the police.

Yes, a 14 or 15 year old boy can be charged with rape.

In the scenario you present, as a prosecutor I would have charged it as rape.

I would also have petitioned the juvenile court to try the rapist as an adult.

I had, nor have I ever had, any tolerance for rape of any kind.

Rape is a devastating crime, whether the victim was an adult or a minor, a male or a female.

Others might feel differently, and in this discussion setting, that is their right.

Even the discussion of rape gets my dander up, so I'll simply STFU about it, now.
 
The young girl was raped...not statutory rape, but aggravated sexual assault which is the most serious form of rape under NJ statutes. The child was under 13 years old and simply cannot give legal consent (even if she'd wanted to participate). The penalty is 10-20 years in prison.
