Pursuant to nj stat ann : 2a-61c-1 criminal and civil liability for shoplifting. If they want to pursue the criminal charges what is the statutory limit in newjersey. And there were no police at the time of incident.

Civil Demand depend son many factors but in most states it cannot exceed $1000.00 how much is yours?
No there is no charges . My question is if they want to press charges what is the statutory time limit for them . I mean like an year or two years . There were no police involved and they haven't told they will press charges.only civil demand sent which is paid immediately. This happend to one of my tenant.

Civil Demand and criminal charges are unrelated. However the Statute of limitations for most misdemeanor thefts is one year

When it comes to misdemeanors in New Jersey, the state has one year to file charges for petty offenses, while most other crimes have a five- or seven-year statute of limitations.

Since the civil demand was paid & no police were called, most likely no charges will be filed.

Hello Betty 3, thank you for your reply. As i explained my tenant got caught at a big retail store.she is 5 month pregnant so i wanted help her in some way atleast for her health.as it will effect her child. She has a doubt regarding the forms she has signed . The LP gave 2 papers one is civil demand which she paid the day she received in full. And the second letter she hasn't read properly . Lp wrote her name on the second form and asked her to check it . So what that paper could be. I guess you guys will know what that paper might be. Can you explain

It's hard to say for sure. It could possibly have been that she will not shop in the store any more or could have been a "confession".

I am a Retail Theft consultant and answer questions like yours daily. Where no one can say for certain what second paper was it would be a good guess it one of two forms.

Acknowledgement (or confession)
Ban form. Its a document stating you are banned from store and possible sister stores for a period of time.

If it's a confession form what are the chances for them to press charges . As this incident took place couple of months back . Paid civil demand within 15 days

If no Police were called at time and you paid Civil Demand its VERY unlikely they would file a criminal complaint as they would have nothing to gain by doing so

Can you clear this last one doubt please.Got to know that second paper was some police department summons programme. What is this and what are the chances to prosecute now.one more thing she called court after a month of the incident took place they said they dont have any record on her .the total stuff she has taken is above 100$

Now your talking something different. If this was a summons then its possible there was a criminal complaint. The Police and/or courts (or any number on paper) should be called to find out

No no it was a paper that if they(store) want they can forward to the department and they can press charges. Even i thought the same that this was different from what she told me before. I think she is reading so many posts on the internet and assuming things . So what if the paper she described was correct will every report go to police .

Its been 2 and half months and also called court there was no record on her .. she called up after she paid demand letter that is after a month of incident took place. She told she vaguely remember there was some logo on the second paper on which lp wrote her name.

You dont give us much to go on but if court has been called and there is nothing then its unlikely there ever will be a criminal filing

I have read of papers of a confession being signed & it would be used to press charges if the civil demand wasn't paid. Since the civil demand was paid, not likely any further action will be taken.
