Parent owner refusing 40 hours

This is a national problem with many companies reducing hours to hiring more and preventing employees from reaching 40 hours and time and half over time pay.

But is this legal?

A friend said he applied to both Olive Garden and Longhorn Steakhouse Restaurants BOTH owned by Darden Restaurants. While at OG they told him he could work at either but only 20-25 hours...My friend told them he also applied at Longhorn for 20-25 hours...OG said "NO!"...Your not gonna work at both at 20 hours and reach 40 hours.

Is that legal even if both restaurants "can" schedule him for 20 hours?
 
It is perfectly legal in any situation for the company to set the schedule and set limits on hours worked.
 
There is absolutely no obligation on the part of the employer to schedule an employee for overtime. There is absolutely no obligation on the part of the employer to schedule an employee for 40 hours a week.
 
Heck, an employer isn't required to hire you, or even interview, as long as the employer doesn't discriminate against you.
 
You all are repeating the same answer that dont have to hire or schedule, thats not whats being denied...OG said (acting/talking for their parent owner Darden) they would hire/schedule but only at OG. He would not be permitted to work at both OG and Longhorn at the same time. OG said they could offer 20, and Longhorn said they could offer 20 hours...BUT OG claiming to speak for Darden will not allow him to achieve 40 hours by denying him working at both places.

Is it legal for them to outright say NO we refuse you working 40 hours spite it can be scheduled. I dont think the over time matters to my friend but to work up to 40 hours is what he wants. Thats is being denied spite it could be scheduled since both places can offer 20-25 hours.

Its been my experience that when several random people offer the same (or similar) answer, the information is at least 80% correct.
You were offered information, you are free to ignore it, or investigate it.

Yes. It is legal for them to outright say no, we refuse to allow you to work 40 hours in spite of the fact that it could be scheduled.

There is no guaranteed right to be allowed to work 40 hours.

And, before you ask, it is legal for them to allow him to work at one restaurant and not the other. Even if they could.
