Falsified info when purchasing a vehicle

My husband just purchased a used 2005 Taurus and was told that the vehicle has ABS brakes. We took their word for it and since there was no vehicle manual that came with the car nor a sticker listing the options, we had no way of knowing the information was false.

My husband went to a local Ford dealership to purchase a manual for the vehicle, and upon reading it, found out the vehicle does NOT has the ABS braking system.

The reason this is so important to us is because we have severe weather conditions here and he has a very long commute to work.

He is very angry about it and wants to know if there is anything we can do about this?

Any feedback ASAP would be appreciated so we can take immediate action on this matter.

Well, actually you could have obtained the VIN, then contacted Ford Motor Company and asked whether that particular car was sold with ABS (or later added), as that was an optional equipment feature for the 1995 model offered by Ford.

Did you purchase the car from an individual or a dealership, and in which State? At this point, I really don't feel that you have a case against the seller unless it was stated in the sale documents that the car has ABS braking system, and you are able to prove that you relied on that statement to your detriment in purchasing the car.

Since, ABS was only an option (not standard) for the 1995 model, it could be that the seller wasn't aware of this, and it was just a mistake on his/her part. If it was a dealership or licensed dealer you purchased from, then you might argue that fact with the manager or owner and ask to exchange the car for another one which has that feature, if one is available.

Oops, I'm so sorry ... just realized I misread ... you said it's a 2005 model (not a 1995 model). However, ABS was also not standard for the 2005 models (only an option), so my remarks above remain the same.

Hi Barbie,

We realize that it isn't a standard option...the question was...is there any recourse we can take because we were told that it came with ABS or are we out of luck?
