On Thursday a friend and i were having a few drinks. Ended up being a lot and the cops came by and arrested us for MIC. He tried to run and ended up with resisting arrest too. We never blew. Im just wondering what kind of penalties im going to be facing and if i should hire a lawyer for this. Also, I received an MIP in august in a different county. Whats going to happen for to my 1 year probation? I was told that i would have to be arrested for the same charge for it to break my probation.

On August 28, 2005, Missouri's new MIP law went into effect and expanded the old MIP law's definition of "possession" to include "possession by consumption" and appearing "visibly intoxicated."

You can find information on the new Missouri MIP law and the Missouri "Abuse and Lose" law by clicking the links.

With respect to your probation question, it is not true that you "would have to be arrested for the same charge for it to break my probation."

The answer to the "do I need a lawyer" question is ABSOLUTELY.
