Last night at a bon fire my friend and I received an MIP. The only reason the officer came to the area was because some genius decided to park their vehicle right near the pit on the grass. When the officers arrived they found two open beer cans sitting on the bench right next to both of us. When the officer asked whose those were my friend replied they were both his so the officer started writing the ticket. A few moments later the officer began trying to blame the other can on someone else, looking at me the whole time since I was closest to it, I didn't say anything until he wanted me to take a breathalyzer test. Being 18 I know my rights and not having to take a breathalyzer test on the spot so I simply said I did not feel that I had to. The officer said that he could tell I had been drinking because my eyes were glazed, I replied this could be because of the fire and smoke getting into my eyes. He started to indirectly call me a liar and gave me an MIP and told me to just deal with it in court.

This is my first ticket and I'm a little scared that something like this may result in my license being taken away, some heavy fine I have to pay, this being on my record, or maybe all three. I am a freshman in college and need my license to get to school and don't have much money since its all going into school fees. Personally I don't think there is evidence to convict me since those beers where my friends and I only exercised my rights as a citizen to refuse to take the breathalyzer test. What should I do?

I think you should find and talk to a lawyer in California who handles MIP cases.

Try asking around to see who has gotten a MIP. Find out who was happy with their lawyer and what disposition the lawyer was able to negotiate. I always recommend talking to a few lawyers before hiring one. You should consider how long each lawyer takes to call you back, whether you feel the lawyer really listens to you when they call, and whether they take the time to fully and completely answer all of your questions. Hire the one with whom you feel most comfortable.

Good luck. Don't let it get you down.
