This divorce was settled thru mediation almost 3 years ago. My ex was awarded a portion of my retirement and I was ordered to cooperate in signing anything she needed to file for this. I did. I retired 18 months ago. She filed for my retirement in Feb 2013 and her attorney is now threatening to take me to court if I don't pay her back pay(from the time I retired until the date she actually filed for my retirement and started receiving it) this was not in our divorce settlement, I was never told or ordered to pay her. Can they now take me to court and make me pay this money? Wouldn't that be modifying the original mediation agreement that was finalized almost 3 years ago?
 
If they want more than the decree ordered, tell her to take you to court. As long as you've done what was ordered, they'd have no case. They can sue, but they are li,ely not to prevail.

Just to be sure you understand, speak with your lawyer.

In the future, you are under no obligation to answer questions, or speak with anyone about anything. Just say nothing, and don't even listen. All that does is upset you.

Without knowing EXACTLY how the order is worded, I'm going to disagree somewhat with AJ.

If you retired 18 months ago, then you would indeed owe her from that point even if she hasn't filed for it yet. Unfortunately this is quite different from child support and spousal support in WA; I have a feeling that you're going to be disappointed in court.

Speak with a local attorney though, who can review your orders.
 
Agreed. without anymore info on the actual terms. your best bet is to speak to a lawyer locally. i wouldn't bring something like this on to a public forum.
