I'm 45 years old, live in Marina Del Rey CA: 4 years ago I got a restraining order against a girl i dated for a while. I was very upset that she broke up with me and was now seeing a friend I had introduced her to so i invented things on the internet such as slandering my Matchmaker profile, had strange men from the site call my house so i could document harassment. I made a false police report and filed DV charges against the girl. I placed several slanderous postings on snitchster.com and said she was doing it. I signed on as her "co-worker" and said i saw her doing the postings. I told the judge that she was harassing me and I got a RO for 3 years.

2 years into it, I had friends send me magazine supscriptions and filed another police report saying that she did it. They dismissed the case against her, because there was no proof that she did it and she had an atty this time. But now my past has come to haunt me. Someone snitched on me. The police had a warrent to search my house and took my computer. I since have a new one. but there is incriminating evidence on my computer there is child porn. I need Help. Can they prove I was looking at it? Can I say it just appeared on my computer? I have a lot to lose a new wife, who knows nothing about all this. I don't want it to ever come out.

Can someone please tell me what I can do about the porn and if all the harassment i did to that girl will be seen if they examine my computer would they find the emails to her? Would they do anything to me for committing fraud? Can she come after me after all this time and sue me? or anything? I have recently driven by her house and I think she may have seen me. I don't want to start a war, but is it possible that she would file against me saying I am stalking her? I have heard she has documents from people who denied they did what I said they did in court. she hasn't persued anything to date, but I wonder if she legally can? Please help!

There seem to be two totally different and independent cases possible:

1. Possession of child pornography

This is a pretty serious matter which can land someone in jail for a year. The law prohibits "knowing" possession. You can always argue that you did not know the stuff was on your computer etc. but it won't be very credible. Don't expect a jury to buy the usual excuses.
If the police obtained a warrant and searched and took your computer and you know there is stuff on it, they seem to have a pretty strong case. May be even a case for possession with intent to distribute which can be even worse. So you should get a criminal defense attorney asap.

2. Filing a false police report, making false statements

This also is a crime, a misdemeanor. If you made false statements to a police officer or a judge under the penalty of perjury this is a felony and you can face prison up to 4 years.

3. Civil action

Your ex-girlfriend also might sue you in civil court for a host of torts, defamation, intentional infliction of emotional distress, abuse of process, malicious prosecution and so on and seek a judgment against you for general and special damages and punitive damages, or in other words, for a huge amount of money.

If you are lucky the statute of limitations might bar some proceedings.

You should definitely consult an attorney

Well I guess you do have a lot to worry about now. Have you told your wife about your child porn? I would say you are pretty screwed. I would not be surprised if the police come back with a second warranrt to search your house and your new computer. In which they will beable to track your statements on this forum and find out you knew everything and did everything.

I committed Fraud for a RO

Who the hell is going to read these stupid forums anyway? the police don't. I'm so sure they would do anything to me! and my wife is clueless. she'll believe anything I tell her.
I'm not worried about her! I remembered I erased all files on my computer before it was seized. let them try. I'm not waisting money on a stupid lawyer anyway,

This is not legal Advice!

It seems you are very bitter about your reply? It can be said though you have had your legal advice. You must remember you are talking about a very touchy subject here that many people find very disturbing. NYClex, gave you your correct advice.that many people would not have! Just for your information though it dose not matter how you erased your information off of your computor it WILL still be there. Every time you erase somthing on your computor it will leave a stamp that can NEVER be erased. You must not get upset and try to think why you are in this situation in the first place, You admit yourself that you have broke the LAW!.

You will need to discuss you situation with a lawyer, so it can be said you might as well find one asap. As for your girlfriend/wife it is your choice weather you confind in her but remember she will soon find out if you don't. I am not passing judgment but maybe you can go and seek help, for your different behaviour. What you think is normal the populas dose not. So go find the help you need to live a normal life and try not to be bitter about your situation, only you have the power to stop what you are doing.

This thread is a repeat of the one you have posted in Violence & abuse.

This thread should be closed now.

I committed fraud for a RO need an attorney!

Can someone please refer me to an attorney in the Santa Monica CA area? or LA someone cut throat who hates women and can really put them in there place

I believe that there is NO WAY that this is a true story you've told to this forum. You state that nobody will read this forum but you obviously don't know too much about computers. They courts can now track everywhere you've gone on the internet and if you are serious and true about these occurrences, they will likely use these posts against you in court. As far you erasing files from your computer so you don't care. You really can't permanantly erase any file from your computer forever unless you really know what you're doing. The files can still be recovered. You said that there was child porn on your computer so that's not good either. You'd be well advised to this point now to get an attorney because these are very serious charges now. If the cops do find that you visited, signed up and posted here in this forum and they read these particular posts, they will use this against you and then likely tell your ex-girlfriend that she has an extremely good civil case against you. I am still not convinced that you are telling a true story because the things that you entered onto this forum are terribly incriminating.

unfortunately it is all true. I need an attorney now.
anyone?

Have you tried the PHONE BOOK? There are plenty of attorneys in there. Why would you ever come to an national forum and look for an attorney? Just open up the phonebook. As bad as everything you think you've done by what you've posted, these attorneys really have no built-in moral compass of their own to speak of (for the most part). Look for someone in your local area. My advice is the sooner the better.

Fraud for a RO

thanks, I've looked in the book I'll just make some calls, I was hoping someone would have been able to refer me to someone local. it's hard to tell what attorneys are like over the phone or even in a yellow pages add. but thanks just the same I will do some more searching

Let this me the end of this little rumor... THERE IS NO WAY FOR THE COURTS TO TRACK EVERYWHERE YOU'VE GONE ON THE INTERNET!!! They may be able to tell certain sites that you MAY have visited, but they can't "track" you. Even if they were reading this forum and saw your posts, it would be hard for those charges to stick.

Fraud for a RO???

What a dick, this guy should be strung up by his balls and left to rot.
Better yet, let the locals especially that ex girlfriend throw rocks at him! :D

Why would any lawyer want to help you? You are really screwed up and you sound like a jerk. i hope your wife smartens up and divorces you, and turns you in.

Your day will come. Don't expect any advice or sympathy from anyone on here.
