Shoplifting, Larceny, Robbery, Theft Theft of an IPhone

Hi I am contacting u guys concerning my son who is 15yrs. Old . He has been charged with theft of an iPhone last year before school ended for the summer. The phone was returned to the individual by the principle of the school. So my so in turn with through a juvenile program where he had to complete something's and pay them $180 to complete the program for this situation. And now that we are almost finish with the payments we are recieving a letter for restitution of $134 . Now I do not understand why he is being charged forthat if the item was recieved and in good condition?

Perhaps he did damage to the phone?

But, why quibble over $130?

All this will do is make more problems for him.

Pay it, and have him get a job to reimburse you.

I believe restitution is often paid into a fund that goes toward repaying victims of various crimes. The $130 is likely not going directly to the owner of the phone, but is a penalty paid into the fund to help pay for various other offenses.

Restitution can be for various reasons. It could be the phone wasn't returned in as good a shape as when stolen (perhaps damage to the phone as noted by army judge). It could be for the reason noted by mightymoose - it's almost like an "insurance" payment to reimburse victims of other crimes than this one.

Anyway, I would pay the money without complaint.

It's up to you but I wouldn't. The restitution might not even be due to damage to the phone (& might not go to the owner of the phone). Also, the principal may not even have tried the phone.......

I agree with everyone here.. it's much better to pay $130 than have to deal with any further damage from this.

OP, what we are trying to tell you is that the restitution may or may not be because the phone was damaged or not returned - it "may" be just a "penalty" & not even go to the owner of the phone. I believe you're going to have it pay it no matter what even if phone returned & in no matter what shape.

I wouldn't drag this on - get everything settled by paying the money & don't cause any more problems for your son.

I don't know what else we can tell you. Maybe your son can do some chores for you or others & pay you back.
