Criminal Law Please Help.. Immigrating through a family invitation but have a crime record.

Hi

I am a foreigner wishing to immigrate to the US.

My father is a citizen and have applied for my invitation as a permanent resident.

My problem is..

During the year 96 I was convicted of armed robbery which i commited in 94.
The crime was commited on US soil while I was a foreign student in the US.
It was my only crime ever commited and I got 4 year probation with 200 hours community
service, no jail time.

I made a terrible mistake when I was young and have worked very hard ever since then
to make up for my terrible mistake.
Now I have graduated with a degree and am a research engineer with a global company.
I have been living outside the us since 1997.


Recently my father was diagnosed with cancer and is in desperate need of my aid.
I have an immigration interview with the consul in my country soon.

I would like to know what are my chances of getting into the US and getting permanent
residency.

I am very desperate because my father is running out of time and I want to be there for him and take care of him for the remainder of his life.


I have some more questions

I would like to know how the immigration process works.

Some time ago I got a letter from the national visa center that they have
completed gathering all of my information and have send it to the US Embassy in my country.
-- Does this mean that National Visa Center has already done a background check and
have given an OK?

If i actually get the immigration visa and make it onto US border is there still a chance that
I might be stopped and deported, at the port of entry, due to my criminal record?

Is there any way I might be able to get a pardon for the only crime I ever committed 9 years ago?
 
Hm, it depends on the exact definition of the crime for which you have been convicted. But generally, armed robbery is a crime of moral turpitude, and usually carries a longer sentence than a maximum of 1 year and therefore would make any immigrant inadmissible.

The visa center sends all the pertinent information to the consulate or embassy and they will make the decision, which in this case probably would be to deny a visa.
