wrongful termination/defamation

i worked for a corporation for over 5 years, was hired by supervisor/relative...found out he was gonna terminate me for his friend because he was in fear i was gonna get him fired for not doing his job and making us employees do most of it. i woulda been 3rd employee to write such a complaint...the new gm had even warned him about his misconduct. when new gm heard of my soon to be termination he said he would pay my unemployment cuz he didnt agree with my outcome. 5+years with no write ups all my customers loved me...when i was terminated they lied to the state and said i voluntarely quit! after i told state what really happened they then said cuz of lack of work, another lie. i have been getting unemployment now. is there anything i can do legally? they have told most of my former customers i quit which is a lie. why would i quit a full time salary job with full benefits? now i broke hand and have nomore insurance....they shuld be held accountable for something!
 
If it wasn't in writing, how can you PROVE who said what to whom?

In the future, get it in WRITING and SIGNED!!

A wrongful termination means that you were fired in violation of the law. What law do you believe was violated by terming you?
 
im not sure what law is broken if any? i have the other drivers word and our salesperson word that he fired me cuz he thought i would try to take his job or get him fired for lieing to the corp for years about what he actually does. like stay home or go to his camp and not use vacation, only show to work to cash us out, have us do his manager visits, put his name on leads he didnt actualy get so he wuld get a bonus. they also kept 28 hours of vacation pay cuz he said i used to many year before when they keep track of it for me. according to him i had 6 days left in december so he let me use 4 n carry over other 2 now i get screwed. the other driver wuld testify he fired me cuz of that reason. what kind of place do we live where u can get fired for being better at a job and way more liked when u have an ol lady, and 2 daughters at home to support (4yrs and 3yrs) had full benefits too full time salary....now i broke forearm with no health care! and im the one who might have to file bankrupcy? it shuld be that idiot! plus hes telln pepl i quit! all lies! and i can prove it. in a place like the upper penninsula its hard to find good jobs now i have to say i got fired from a job. plus there r no jobs to get here. im at least gonna be the 3rd person to write ceo on what a worthless piece of human he really is....is there a civil case for any of this? he needs to pay for his actions!
 
No it does not. a "wrongful termination" is a firing that violates law, employment or union contract. If you cannot prove any of these then you have no wrongful termination case. Unfair and unlawful are not the same
 
what exactly do i have to prove? couldnt i sue for defamation of character? they lied to the state unemployment agency and said i vol. quit then lied again the 2nd time and said i was fired for lack of work but they had already hired my replacement...thats on record from uia
 
You may sue anyone at anytime for anything. You can even win. Problem is collecting. The whole law suit process can take a year or more with no promise of victory. If you cannot find an Attorney to take case on contingency you could wind up paying your Lawyer a lot of money again with no promise of victory.
 
You have no viable case as far as I can see.

Forget defamation - you can't afford it, and they can bury you with legal fees. Move on with your life.
 
And to clarify something, a defamation suit will cost YOU in excess of $50,000 and at least 3-5 years to litigate.

shrinkmaster, defamation cases are rarely taken on contingency unless your last name is Flynt or similar.
 
thats what sucks ive lived her all my life 33 years went from being middle class to filing for bankrupcy because of 1 idiot supervisor who is a relative and had a grudge....guess my lousville slugger
 
thanks for all your advice also, guess i gotta choose a route now...what kind of world do we live in where employees have no rights or barely any? just sent my letter to the ceo of company explaining everything including how i will protest and picket their service here by starting with all my former customers who already are on my side...no way i'm a quitter my kids and wives livelyhood r on the line!

Seriously man - if you care about your wife and kids, MOVE ON with your life. Don't make an example of yourself.

With regards to your rights, you have no idea. Do you realize that you live in a country where you can quit your job without notice for any reason with no repercussions?

Do you know how unusual that is in say, Europe? The rest of the world?

(And believe me, your former customers aren't going to join you - I'd bet that they suddenly become very sparse when it comes down to the wire)
 
ive already had former customers quit because of it i would simply go to my former places and let them know whats going on with it and encourage them to switch companies. we live in a small town i know 95% personally most of my life or went to school with them or coached their kids in basketball or baseball...im not doing anything drastic by any means a lettr to the ceo a letter to the local paper where they print opinion lettrs to editor daily just to let it known what kind of people they are...i know thats my right! plus the head sheriff and police chief are refernces on my resumes if it does get touchy touchy but i wouldnt stoop to the companies level and be stupid. im a stand up citizen and volunteer in my town and have many many people im my corner. i would move on if it was even possible to get a full salary full benifits job....it is not here
 
and i promise im not gettn testy, just venting a bit at situation and i appreciate all the feedback just trying to get everything out there since ive never been fired before and i even worked for the state for 8 years prior to this crap job....thanks to our former gov. granholm who cut our program due to her awesome state leadership while shewas in office...
 
Unfortunately, bad things sometimes happen to good people. You have no cause of action against the employer that I can see. But if you keep trying to interfere with their doing business they may end up with a cause of action against you.
 
id say thats bogus because one of our community groups made a push the last 2 summers for all local business owners to drop our service in favor of the local vendor, who provides same service. i lost 3 or 4 accounts because of it. whats the difference? they had multiple meetings to discuss and encourage people to do so
