first, the habitat was where my mother and i lived, she found some stuff missing reported it to the police.she tried to drop charges state picked them up .i took probation,to get released and file an appeal,i didn't file continuece and violated probation the judge gave me 2 seperate probations 1 credit card abuse 5years running with a 10 year for burglary.at vop hearing my mother testified it wasnt a burglary.the judge senteced me 2 years state jail and reinstated the 10 year probation.during that time mom passed,i was released on dec 21,2011.my probation transfererd to dallas.i have paid all court cost ,fines and fees to date.over 10,000.00 most of the estate i got.my probation officer in dallas violated me for missing an appt.while incarcerated i completed 90 inpatient drug program, got ged and took 12 other courses that i have certificates for ive also completed 36 hours community service.mom hired a private lawyer during my incarceration, but she has done nothing to get me relief from this now im facing the violation and i dont think she will represent me to the best of her ability.the judge that presided over that court has retired in lieu of the recent indictment of judges taking kickbacks from safe p.i also have ptsd, anxiety, and depression not at all adressed by the court about my mental health issues.what am i looking at and what should i do?

Yes, it was a burglary, even if you lived there and even if mom didn't want to be a victim. A strict application of the statute only requires that you entered with intent to steal or commit another crime.

As for your violation while in custody you likely don't have much to worry about so long as you show up in court and provide proof you were in custody at the time. That is a very common violation, and commonly dismissed, however if you fail to show now then you have a whole new mess.
