Harassment, Stalking, Misconduct Disorderly Conduct

I was recently arrested for Disorderly Conduct. Basically, I was at a bar, and I witnessed several bouncers take down an "unruly customer", and one of the bouncers kicked this man in the face, causing him to lose some teeth. When the police showed up, the bouncers were giving a false story of what happened, I tried several times to tell the officers what really happened, finally the officer got loud and told me to "get the f#*k out of here" so, I walked away, as I was walking away, the bouncer that I witnessed kick this gentleman in the face, was now in an argument with my friend, my friend whipped out his camera phone, and immediately began recording, incase something went wrong, this bouncer grabbed his phone, and put it in his pocket, when I tried to get the officers attention to tell him that this bouncer had stole my friends camera phone, he came over and said "well you just dont know when to shut the f#*k up" put me in handcuffs, and I was taken to the police department. I was never read my miranda rights, but thats my word against his. I also found out while I was in the back of the squad car, that the bouncer I had saw kick the man in the face, and take my friends cell phone, was actually an off duty local police officer. So im assuming thats why they didnt want to hear "my side" of the story. I also asked several times before I was released from the police department, to see the police report, so I could know what exactly I was being charged with, but he refused to give me any additional information, besides when my court date was.
I am just trying to see how I can beat this charge when I go to court. I have never been arrested, or been in any sort of trouble. I am just really confused about how I got arrested for Disorderly Conduct, when I was just trying to help, or at least I thought thats what I was doing, and how I can make sure this does not appear on my record. Thank you
 
Contact an attorney. I'll bet he'll have a good chance getting the case dismissed.

They don't need to read you your rights if they're not going to question you.

It's always best not to confront people the way you and your friend did. You could have avoided the arrest and gotten really good evidence, had you been discrete and video recorded the activity without getting in their face. You could have later found out who the guy being assaulted and arrested was, and given your statements and video to his attorney.

:yes: Maybe he was right about that.

Things are best resolved in court, not in bars when people are drunk and fists are still flying.

OP, here's what you need to do.

There is an African proverb that goes: "The story of the hunt would be different, if the lion could tell the tale."

Here's how this works.

What you want to say is of no matter, moment, import, or consequence.


Think about OJ, Scott Peterson, or some other know it all withering away in some squalid prison.

Talking only ends up with you braiding the hangman's knot, putting the rope around your own neck, and then pulling the plunger that sends you plummeting to your own earthly demise.

Don't commit legal suicide.





So, from this point forward, shut up.



Forget that crap you see in the movies and on television.

This isn't a capital case.




At worst, you're charged with the lowest level state misdemeanor, a breach of the peace type offense.

More than likely, it is a lower level city ordinance violation or offense.





Miranda warnings were not applicable in your case.




So, forget trying to become a 10 minute Perry Mason or Clarence Darrow.



What is that?

Some lawyers might say you want to be a "microwave" or "instant" lawyer.

Check yourself, before you end up wrecking yourself!!!

Have you ever been to traffic court?

That's what this will resemble.



So, going forward, shut up about this.

When you appear in court; be punctual, dress in business attire, remain calm, be deferential at all times, be respectful of the court and it's rules,
be polite at all times, use "your honor" or "judge" when you address the court, and don't be argumentative.


When you're called to stand before the bench, rise and approach (as directed by the bailiff), speak clearly and project your voice, plead not guilty and answer questions with "yes or no" YOUR HONOR, as appropriate.




Do not tell your story, this is not the time or place.

Do not make demands.

No one cares.

Look what demands have got you so far?
Then ask for the court to appoint you an attorney, or ask for time to hire your own.

Stay out of any trouble while awaiting adjudication of this case.


When you have retained counsel, then and only then, do you relate to your attorney your version of the events that culminated in your arrest.


Do not try to play lawyer, because you think you can talk your way out of this.


It never works.

No one cares.

They have the power.

They make the rules.

Don't pay a game you can't win.

That's what your lawyer will do.
Now, take a deep breath and reflect on the incident.

Write down everything about the event.

That is what you'll relate to your lawyer in due time.

Last, but not least, even if you're convicted; nothing bad will happen to you.

You'll likely pay a fine and fees, be out in probation. And in 90, 180, or some set number if days; your conviction will be erased if you comply with the judge's instructions and obey the probation officer.

In essence, this is much ado about nothing.

Now think about how or what got you into this mess.

Your answer should be "your mouth"!!!

Had you observed and stayed out if this, you wouldn't be IN this now!

Think before you leap, then don't leap!!!
