how can i go about changeing my childs last name legally

my wife and i have a 4 yr old girl that is not legally mine but she was born while during our marrage she has a diffrent last name then mine the state already says that i am the father because we where married when she was born, the courts rejected her fathers plea to see her because of him being unfit. we want to change her name legally please help

He4r biological "father" has no rights to the child? You will have to seek his permission to change the childs last name if he does. If not then seek a attorney and see options on adopting her. Good luck.

no he does not we went through the process where he could have been given the rights to her. the Judge gave me all his rights because i had been there since she was a month old. and he told him if he wanted to appeal that he could. thats been almost 5 yrs ago and he has not done anything
