Bookeeping error.

Due to a bookeeping error my loan with a major car corporation was paid in full and a security interest(lien) was released on the vehicle and sent to the DOT.Now two months later they are making harrassing phone calls and telling me this debt will be put on my credit if it is not paid.Can they do this? I have the letter closing the loan and the title release.They have demanded this paperwork back.
 
Can you show proof that you paid the loan in full according to the amount you agreed to pay on the contract?
No, you don't. They made an error, discovered it, and are not correcting that error.

Had you overpaid would you think it fair if they refused to refund the money?

It's a two way street. They can obtain a judgment and put a lien right back on that car.

Also, calls made in attempt to collect a debt are generally not considered harassment, though you may find them annoying.
 
If your confident that all payments were made and the release legitimate, I would by all means allow THEM to prove you owe xyz. Do you recognize the company reaching out to you for money? It sounds at one point you may have been late on a few payments throwing your file into an "oh no" bin that was more than likely sold to a JDB who is now "harassing" you with old loan information. I would definitely make sure the people contacting you are affiliated with the major car corp AND ask them to send a detailed payment history up to and including when they say the loan defaulted.

I would never take a collection call at face value...do your research...gather your bank statements...make sure all payments were made (irregardless of is they were made timely) and simply request the information from the collector to support their claim.

Mighty...we both know the chances of them moving forward with a judgment for a few payments is highly unlikely...it sounds like the paperwork involved to chase down a few bucks couldn't be worth their time...unless of course were talking a stretch limo here.

Depends how much is owed.
We don't know if this is regarding a few payments or many. All we were told was that the lien was lifted prematurely due to a bookkeeping error.
 
Agreed Mighty completely...in my experience it really doesn't matter if it's a few payments or the latter...it depends on the proximity and the value of the debt. It is highly unlikely that anything will unfold...IMO...gather your documents and don't wait by the phone...
