Vacating a Judgement & Suing Law Firm/Collection Agency?

I was made aware that there was a judgement against me when I received a letter from the law firm stating a judgement for $2042.61.

(1.) I need to have the judgement vacated because the firm/company who sued had no right to sue me nor did they issue a summons or notify me that they had filed a case in NY Civil Court. I had been in touch with the law firm prior to the civil suit because they sent collection letters. I had informed them that the debt was not valid and was due to identity fraud. The firm informed me that I would need to provide proof, which I faxed to them. The orginal creditor also not only informed the firm/collection agency that the debt was not valid, they purchased back the debt.

Q.) Should I simply file to vacate the judgement? I would also like to sue the firm for suing without right and for obtaining a judgement against me, damaging my reputation and my credit (not to mention wasting my time, the court's money, time, and resources, etc). How do I go about this? Do I need a lawyer, etc?
 
First verify that a judgment actually exists. It is very possible that it does not.

If there is one, all you should be concerned with is vacating the judgment due to lack of service. You won't get anywhere trying to sue them with those kind of arguments. Using a lawyer would be easiest if you can afford it, but you don't need to have one to vacate a judgment. A little research on procedure will get it done for you.
 
100% agree with mighty....keep the good fight and stay tough....guaranteed you'll eventually lose this penpal...
 
there seems to not be much to hope for in courts when even the people who know about the law advise me to
not expect to be treated fair and accoding to law.

I see how people gets bad attitude because I have one now.
