Lawsuit

A friend of mine was told that she has been sued in a small claim court (a TV show got her name from the court and contacted her). The problem is that she has not been served with any court papers and therefore is not aware of the lawsuit.

We think that a process server (for the plaintiff) has served or left the court papers to a different person thinking that it was my friend.

People told us that servers do not need to obtain signatures from defendants when delivering court papers. They just leave the papers where defendants live and certify that the papers have been delivered and served. The problem is that they can drop the papers off at wrong places.

My friend does not want to call the court to find out about the lawsuit because she believes that if somebody wants to sue her, they need to serve her properly. Is she right in saying that and what problems she may have for not contacting the court? Thanks.
 
Your friend has a point. Problem is, it could end up costing her. More than likely, the plaintiff will get a default judgment against her.

If she was smarter, she'd go on the tv show. Win or lose, she'll have the matter disposed if, a free trip, and she'll make some extra money!

She would be smart to appear in the show.

Yea the show is the way to go. Either way she will be served or as army said the plantiff will get the judgment. Atleast on the show she can make some cash even if she doesnt win. The shows outcome is final. Good luck.
 
That's something that many people don't seem to realize is that the tv show is paying the cost of the case including the settlement. So if the defendant looses, big deal. They aren't actually out anything. That's why I always had to shake my head watching the People's Court when someone would loose and call judge Wapner all sorts of names in the post interview with Dough Llewelyn. BTW I blame him for us being so sue happy these days. After all those years of him saying "So the next time the neighbors dog s--ts on your yard, don't take the law into your own hands, you take 'em to court." people actually listened.
