Car dealership failed to send in my GAP coverage

I bought a car in 07'. I bought the GAP insurance coverage for the vehicle. I called 2yrs later to get details on the coverage and it turns out I do not have GAP coverage. I have my documentation saying I do, signed at the time of purchase. I asked the dealer to look into the matter and a month later I hear nothing. I called again and they keep seeking more time to investigate. I told them I am going to check on my legal rights and they hang up on me. Is this a breach of contract on their part? If so, what action do I take?
 
If it is in the contract then you will be covered... eventually.
If the GAP coverage shows on the contract then the cost of the coverage most likely is included as well, and you have been paying for it.
They have a discrepancy to work out. If your car has been totaled and you are needing to cash in on the coverage then get in touch with the agency that financed the car. You can cut the dealer out of the loop and go directly to who is responsible for the GAP.

Your best action at this point is to make copies of your contract that clearly shows the GAP option selected and paid for... and provide that documentation to the agency responsible for providing the coverage. If you are trying to cash in then stay on top of them... if it is not an emergency then give them a few weeks, but keep in touch.
 
I dont believe my problem lies in the GAP coverage co. I am thinking the car dealership is scamming me on the gap coverage. I think they charged me for the coverage, never sent in my payment, and hoped id never inquire about it. The GAP co. says they have no record of me, my phone #, my vehicle vin, nothing. I received a call today from a person from the dealership (after a lady from there hung up on me yesterday) and he asked if I was looking to cancel my GAP coverage, because he thought "last time he spoke with me thats what I was trying to do". Although I have never spoken to him on the matter, nor have I ever inquired about cancelling GAP coverage. (I was told today by a friend who works for a dealership GAP coverage is not something you can cancel) Oh, and the man at the dealership said he talked to his rep from the GAP co and that I do have coverage. I told him good, can I have my policy number to follow up with? He said he didnt have it and he would have his rep call me with it. I waited the rest of the day with no response from his rep. I feel this was a total scam from the dealership. What should I do and where do I start?
 
Again, if you have sufficient documentation in the contract you signed when you first bought the car, there should be no dispute. I would recommend walking into the dealership with the contract and ask for an explanation as to why the GAP insurance company has none of your information.
