Might not be necessary. Looks like all they have to do is wait two years from the injury to the victim per TN Code 28-3-104:

2015 Tennessee Code :: Title 28 - Limitation Of Actions :: Chapter 3 - Limitation of Actions Other than Real :: Part 1 - Miscellaneous Limitations :: § 28-3-104 - Personal tort actions; actions against certain professionals.

Then they can leave him whatever they want.
