My husband works in a fastfood restaurant he got injured and was in pain and found out of a neck and shoulder injury
having on workers comp for almost 6 months makes us financially so drained.

Can we go to other avenue to claim or file a law suit to the company he works.
Where can we get a good lawyer?

Thanks

Sorry, but workers comp is your sole remedy. While you certainly can hire a workers comp lawyer to make sure his rights are protected, you cannot file a lawsuit against the employer. The workers comp laws are written specifically to protect both parties.

WC pays 2/3rds of the average weekly wage and is tax exempt. Most make roughly the same on WC as they did working and paying taxes. If he is getting significantly less, I would have him make sure that they have the correct wage rate. All medicals should be covered without out of pocket expense.

Without knowing what the injury was and how it happened it is impossible to say if his is one of the very few with either 3rd party rights or the ability to sue outside the WC system. This is rare.
