I bought a car from a dealer 1 week later I had to change the oil, put in new battery, then a power steering pump. Then the car wouldn't accelerate, so I called the dealer they picked it up, demand that I paid them $400 to fix the throttle body, I refused. They kept the car and my down payment plus the first month payment. They refused to give me the car nor my money back . They say they will no longer finance it and that I have to now pay it in full in order to get it car back unfixed. Do I have a legal recourse against them? if yes how do I go about it?

Do I have a legal recourse against them?

If all this happened within the first month, then yes, you might have recourse.

However, if a month has already gone by and you haven't made the second month's payment then the dealer has the right to repo the car and call in the loan as a result of default.

I suggest you take your contract and your situation to an attorney.
