Can rent increase rates vary for cash renters vs. section 8 renters on multidwelling property?

Can a landlord raise the rent at different rates dependent on whether you are a section 8 renter or cash paying renters?

Assuming that all renters continue on a month to month tenancy upon expiration of lease.

If the size of unit is equal amongst the 6 property dwelling, if all units were 1 bedrooms, must a rent increase rate be equal to both types of renters?

If the size of units vary between 1 bedroom and 2 bedroom should the rental rate increase still apply the same to both types of renters?

If you cannot find anything in there that prohibits a rent disparity between Section 8 tenants and non-Section 8 tenants (and you aren't in a rent controlled city) then it is not illegal for a landlord to charge different rents for different people.

However, a tenant might have recourse if a tenant can prove that the disparity is due to discrimination of a protected class (age, race, sex, children, etc).
