I was charged with retail theft. The item was $6. It is my first offense and I have no criminal history. It is a summary offense. I see that the maximum is $300 and/or 60 days in jail, but I am assuming that is for aggravating circumstances and with priors. The judge made my fine $200. I plead not guilty. Can the judge up my fine/sentence for pleading not guilty or is the only difference that I will pay court fees? If he can up it, I may just want to change my plea to guilty. Thanks for your help.

State you live in? It seems that he may lower the fine or perhaps dismiss the case. Or he may order to pay the fine and seek counseling. I hope everything turns out good for you.
