My wife just had an accident, while driving with her mother-in-law. No one in either car (both SUVs) was injured. She was ticketed for failure to stop. She did not see the other car (at night, black car, car was speeding, but no ticket). The other car had the right of way, since they had no stop sign. She has only had a license for ~8 months. There were 3 (or 4) people in the other car. Strangely, immediately after the accident, 2 (or 3) of the people, including the driver in the other car ran off, leaving a women (non-driver) behind. (She was handcuffed initially by the police. The other two (or 3) returned during the accident scene investigation and the cops cuffed the driver and put him in the car and took him to jail.) My wife called the police immediately after the accident (serious damage to both cars, ours is probably totaled). This is her first ticket. Should she fight the ticket? There were no witnesses, other than the people in the other car. Please advise.

She could fight it but that depends if there is evidence that she did not fail to yield. Is their any type of sign there? Was it a intersection?

It sounds like the ticket is legitimate. She either failed to stop or failed to yield to the oncoming vehicle. The other vehicle had the right of way- her chances of beating that ticket are slim to none.

None of the rest of that information has any bearing on the citation she received.
