A child was taken out of mothers custody and placed in foster care bc of drug test failed for meth and thc. what were her rights at that time?

She had the right not to take substances that placed her infant in danger. Outside of that we cannot say as we do not know the circumstances behind the case. She should consult an Attorney to discuss how she may regain custody of her child. This is not uncommon if a Doctor discovers a child is born with an addiction.

Ditto Shrinkmaster - she had the right not to be using drugs while caring for her child. The child has the RIGHT to live in a safe environment, and this is not the case in a home where mom is tweaking.

At this point, mom can consult an attorney to see what actions she might be able to take to expedite the return of the child. But, I suspect any such reunion is going to be contingent on mom getting clean (marijuana, too) and submitting to parenting classes and regular drug testing. It's crunch time - her dope and lifestyle, or, her children ... her call.

We don't know the age of your child (may not be an infant) but doesn't matter - you need to talk to an attorney to see what he/she suggests you do to get your child back.
