Revoking Child Custody

My ex girlfriend has custody of our 3 year old son...She currently has no permanent home...She has been staying here and there with friends and she doesn't have a job...I was wondering what process and how hard it is to have the court change to
custody over to me...I have a stable job and a stable home and could care for him much better than she is...The last time
she came to pick him up from my house my son cried and didn't want to go...I never know where he will be staying when he
is with her...She pretty much lives out of her car...I am not even sure my son has a bed to sleep in...What options do I have...Should I call CPS and report he is not carrying for the child or just try to find an attorney to handle the case...
 
You've seen the child. You know if CPS or the police must be contacted.
It's never about custody. It should always be about what's best for the child.
If you've established paternity, put yourself on child support, you can discuss the custody process with an attorney.
Before an unmarried male can consider custody, he must first establish paternity.

If you fear for the child's well being, don't wait, don't deliberate, contact the police.

yes I m the child father and I am listed on the birth certificate...I pay child support and have visitation rights...What I don't have
it 10 grand to retain an attorney...The child is not being abused but the mom has no home to live in and is just staying here and there with friends and not providing a stable home for the child...
 
Not taking sides! Explain how this is NOT a stable home? If you want to wrest custody from Mom you need to show court child is in danger or at risk living at present local. Where having an Attorney is advisable you can file for custody without one.
 
The mother was living with her Dad she now is not living with there but instead speeding the night with several different people...One night she stays with one friend and the next night she stays with another and so on...Since she has custody isn't she suppose to provide a home for the child ? How do I go about filing for custody without an attorney...If I can represent myself is

Just so you're aware....

There are parents who have been couch-hopping or staying in shelters and they've retained custody of their children. It's not as black and white as you think.
