mother is a meth head got caught by cps

Mother got caught by cps. She denied the drug test, admitted doing meth since 14 now she is 25 n also ask cps help telling she is willing to change. Biological father smokes pot in past but quit recently got positive in hair straind test. Is cps going to give child to bio father?
 
We have no way of guessing.

But generally, he'd be the first person in line to get custody. Pot use is not meth use. HUGE difference.
 


CPS doesn't GIVE children to anyone.
CPS extricates children from dangerous or precarious situations.
CPS then goes to court, if necessary, and the court determines what happens next.

Dad is sitting in a better spot than Mom, based upon what you reported.

But, as the fabulously informed Ms. Pro said, there's no way anyone can predict what a particular outcome will be.

What Mom and Dad should do is get clean and sober.

But, weed use doesn't rise to the level of meth use.

No one here can predict what cps or a court will do as we are not privy to all the details of the case. If cps and courts feel the child is not safe with one parent and safer with other than its possible the child could be given to other parent
