What are the sentencing guidelines for someone who is being tried for commercial burglary. Pertaining to someone using someone elses credit card and then to find out it was someone elses stolen credit card. Charges estimated to be $750 or less. Also if person is a first time offender.

And what was the nature of the incident?

It is likely a burglary under California statute- entering building with intent to commit a felony or any theft. In this case theft by fraud with stolen card. A petty misdemeanor becomes a felony by walking through the door.

If you are being tried, you must have a lawyer.

You are setting yourself up for failure.

Rule 1: STFU about your case,except to speak ONLY to your lawyer.

Rule 2: If you don't have a lawyer, hire one, or ask the court to appoint one to represent you.

Rule 3: STFU about your case, except to discuss it ONLY with your lawyer!!!
