I work in a small factory outside of Chicago. We have about 30 employees. I got hurt on the job and had an injury to my arm. The company had me work on a floor that isn't clean and I fell because they don't sweep the floor enough and I fractured my arm. Do I need to sue the company? Do I get workers compensation benefits?

No and Yes. There is no need to sue the company - in fact, in a workers comp situation you may be blocked from suing them. But if you were injured at work, you should be eligible for workers comp. Did you file a claim? If not, please do so at once because there is sometimes a limited window to do so.

The first step is to file a report with your employer and request knowledge of their normal procedures. Not counting emergency treatment of course.

Any time you are injured at work you should always notify your employer & file a WC claim.

I don't see a case to sue.
