My mother has been working with an Elder Law Attorney to prepare her estate and was ready to set up an Irrevocable Income Only Trust for Medicaid purposes. The beneficiaries are myself and 4 siblings, equally. I am to be the Trustee and my sister as successor Trustee. None of the other 3 siblings have any knowledge of mom's preparations and mom is very determined they never know until her death. Now she finds out the beneficiaries will receive annual reports of the trust according to the draft IIOT furnished by the attorney. This is a deal breaker as far as she is concerned and does not want any other person to have any knowledge of her IIOT. Is it possible to have an IIOT without all being beneficiaries informed?

I suggest you discuss mom's concerns with her attorney.
You're shelling out good money for professional services.

Speak with her attorney.

There is a solution, if you take the time to voice your concerns.

It would be unethical of me (or other attorneys) to interfere
with or in your mom's existing attorney-client relationship.
