My neighbor has a 6' brick retaining wall (attached to his house) that is also about 6' onto my propety, verified by multiple surveys. Both houses were built about 3 years ago and forclosed. Can I make the neighbor tear down the portion of the wall that is on my property. He says that it is structurally part of his house and can't be done. What are my options?

You can tear it down.

But, don't.

You should speak to a lawyer about adverse possession.

If you don't do something to cure his adverse possession, he'll end up owning the portion of your land on which he has encroached.

Take him to court and get a court order directing him to tear "down that wall".

A good lawyer can also get him to pay your legal costs and pay the cost of removing the wall.

So, talk to a couple of tough, no nonsense attorneys and get the ball rolling!

It varies by state.

I don't think its less than 10 years in any state, nor more than 20.

You're no where near the limit.

Go talk to a local lawyer.

That's where the real work will get done.
