    rape

    okay so my bf is 25 and he had consensual sex with a 16yr who had lied about her age at the time and is now claming he raped her and now is in jail because of her lies what could i do.? we live in Tx

    Pay for his attorney.

    That is quite literally the ONLY thing you can do at this point.

    Advise him NOT to discuss the case with anyone, except his attorney.
    Advise him to plead NOT guilty.
    Advise him to make no statements about this to anyone, especially the police.
    Tell him NOT to discuss his case with other inmates.
    As Proserpina said, hire an attorney to represent him.


    If your funds are low, ask him to have the court appoint an attorney to represent him.


    Finally, never, ever, ever discuss this case with him over
    the phone or in person.


    The jail records everything he says and others say to him, except for his attorney.

    He will want to talk about this. He will want to profess his innocence. If he starts to do that, tell him to shut up. If he insists, hang up. Do not discuss his case while he is in jail.

    You, him, everyone is being recordered!!!!

    FYI, your bf appears to be guilty of statutory rape. A 16 year old cannot legally consent to sex in Texas and he is more than 3 years older than she is so there is no close in age exception applicable here. "She lied about her age" is not a defense in any state.

    That being the case, the above answers are correct; the ONLY thing you can do is get him an attorney and encourage him to keep his mouth shut about what happened.



    (not to mention keeping his pants zipped unless he knows for sure how old his partner is)
