Help with Ebay sale and small claims

I sold a 20 year old stereo on Ebay for $150 and listed it as used. The person who bought it claims that it did not function correctly and that it blew his expensive speakers. He had the stereo repaired for $75 and now wants me to pay the $75 plus $425 to replace his speakers ($500 total on an item that I sold for $150). I offered to refund the $75 for the repair but he is not satisfied. He plans on going to small claims court which I don't want to do cause it is 2 hrs each way. I did not even offer a warranty on the stereo...never mind his speakers. If he files with small claims and I don't drive all that way...will I lose the $500 claim? Any suggesttions or thoughts on my liability?
 
You'll lose a small claims case by default, if you fail to appear.

Does he live in NH?
 
yes...he also lives in NH...about 2 hours away which is were I will have to go. Can i just submit a statement to the court?

Normally if you fail to appear, you're in default.

The other person prevails.
You lose.
Settle this, appear, or default.
Your choices are few.
eBay gets people into trouble and often causes them to lose money. The real winner on eBay, is eBay. eNay is like a casino, they never lose.

Thanks any thoughts to my liability for his speakers? As mentioned the stereo was about 20 years old and I did not even offer a warranty on the stereo (but I'm willing to pay for the repair)...why should I be held responsible for his speakers? The stereo only sold for $150 but he wants me to pay $500!
 
I don't see how you're liable for the alleged damage or destruction of his speakers.

He'd have to prove the cause if the damage.
He'd also gave to prove the speakers were working, if I were litigating this case.

But, why would anyone buy a used stereo for $150 and use it with speakers worth three times the value of the speakers?

Dude could be a scammer!!!
 
I don't think you are liable for the $75 either... the sale is done as is. Who knows what he may have done that caused it to blow out.

Have you been served court papers yet? If so... or actually even if not.... contact the court and ask about jurisdiction. It is very possible that he may have to file the claim where YOU live and that he will have to travel closer to you.
 
I contacted my local district court and they said he could sue me in his district. in fact she said people file here against people in MA and they would have to come here to defend. Sounds strange...what if the person bought the item online and lives in Texas...he could sue me there? Any other thoughts or suggestions? Thanks again
