Got hurt at work. My employer has a no-fault attendance policy. Filled a first report of injury report within 24 hours. and worked the rest of the night and one more day after before going to the doctor. The required doctor for the agency seen me and said that I needed to see a surgeon because it may be a hernia. My schedule was to be on call one day then work three in a role. My nursing supervisor told me that the absence for the on call day would count against me as an episode on the no-fault policy. is this possible when it is a work related injury and I was off because they could not find a suitable positon for my light duty required by their MD. My policy from the hospital that I work for states that exceptions to the no-fault policy include workers comp. would this not be workers comp. The episode has already been counted against me, now they have found me a job in bed mngt that fits the lite duty requirements. Workers comp started 4-19-10. job was found after my on call day. Now I have this as another episode and may be fired.

Don't worry about employer policies, because they do not eliminate state law.
Kentucky state law is what will determine when and how you get paid.
That coupled with what the physician has to say.
If you have surgery for the hernia, you'll have weeks of recuperation and bed rest.
Speak with an attorney tomorrow,a nd let him/her fight your battles for you.
The attorney will not charge you anything.
He'll be paid when you get paid.
The state will pay his fees for representing you, and a contingency on what he wins for you!
Hire a lawyer, tomorrow.
