Hey guys,
I have a quick question i have been meaning to find an answer to.
If a group provides a searching service, where you hire them to search for trademarks, and they charge for this, and then the search comes up empty handed, with the applicant paying a fee but having a result where there, would be conflicting trademarks (not getting anything), and having to pay again for another search. Would this be a wrong doing by the company doing the conflicting trademark searches?
 
If the trademark is easy to find then you may have some remedy against the company. There might have been negligence in performing the services and a breach of contract. It depends upon what service they were providing and the performance of that service.
