Child lives with Grandmother who does not have legal custody. Taking father to court.

Hi. This is a question about child support. It's a weird scenario though.

The Mother of the child does not live with the child, nor does the Father. The child lives with a Grandmother (Mother of the Mother of the child), who does not have legal custody. By legal custody, I mean that the Mother of the child never gave up her rights or signed them over legally to the Granmother. At least not that the Father is aware of.

The Grandmother is now taking the father to court, for child support. Does she have any actual chance of obtaining it from the father? Does she need to be the legal guardian?

Also, if the Mother did sign over legal custody to the Grandmother, would the Father be notified of such an arrangement?

A: if both biological parents are still alive the courts would want the child to be with one of them unless thier both crack-heads.

B: If granny does not have "legal custody/gaurdianship" what the he!! is DAD doing not going to court and asking for custody knowing the mother is'nt taking of the child?? The child is the parents obligation and responsibility not granny's.

C:File a motion to change custody over to the father under the grounds of child abandonment by mother before granny has a chance to get the child support motion into play.
 
Grandma should fight for custody and seek child support from both parents. I can't understand why the majority of females don't think the laws of support apply to them.
