drainage for abandoned project

My jurisdiction is: New York State

In preparation for building a home, neighbors filled in almost 1 acre of land raising it about 4 feet higher than surrounding properties. Village and Code Enforcement Officer were aware of the neighbors project to build a home but did not make them submit any written plans or acquire any permits before commencing to fill the land.

Water and mud run off started affecting our property, and Code Enforcement Officer (CEO) issued neighbors a code violation letter. However, neighbors finished filling in their property and then abandoned their plans about building the actual house. Instead of pursuing the owners about the mud and water run-off onto our property, the CEO then reversed his findings and is now saying the neighbors have not done anything wrong since no structure was placed on the property and they never had any permit.

Is the village board or the CEO responsible in any way for not enforcing local zoning or state codes? Is the owner responsible for drainage even though he changed his mind about building a home?
