Well share disputes

:mad:I have lived in my house for 11 years that shares a well with 4 other houses. Everyone pays $65 a year for the electric bill to run the well and is responsible for 1/5 of the bill in case the well breaks down. The arrangement has worked well until about 3 years ago when one person refused to pay their $65.
Since then a new person moved into one of the houses and refuses to pay the $65 a year. I am afraid when the well breaks down these 2 people will not pay their share of the cost. There was never any legal agreement for this. The well is located in my next door neighbors yard. What options do we have to force the other 2 homeowners to pay their fair share?
 
Where do the neighbours derive the right to use the well? From a bylaw, from a covenant that runs with the land...?
