Ex tenant vacates then brother refuses to leave. squatter or illegal sublet help!!!!!

My jurisdiction is: california

I AM A LANDLORD IN OAKLAND CA. ABOUT A YEAR AGO, I RENTED MY 3 BEDROOM APARTMENT TO A SECTION 8 TENANT AND HER SON WHO IS ALSO HER CARETAKER. DURING THIS TENANCY, HER OLDEST SON (NOT ON THE LEASE) BEGAN TO STAY WITH HER BECAUSE HE WAS HOMELESS. I KNOW THIS IS A VIOLATION PER SECTION 8 RULES FOR ILLEGAL SUBTENANCY.

WHEN I FOUND OUT ABOUT THIS I WAS TOLD BY MY TENANT THAT SECTION 8 WAS INFORMED OF THIS OTHER SON STAYING OFF AND ON WITH HER, AND THAT IT WAS NOT A PROBLEM.

ALSO ON THE PROPERTY THERE IS A 3 CAR GARAGE WITH A STORAGE AREA BEHIND IT THAT THE 2 SONS USED TO USE AS A SORT OF RECREATION ROOM WITH A TV AND A COUCH.

RECENTLY, I RECEIVED A 30 DAY NOTICE THAT THE UNIT WAS GOING TO BE VACATED. AFTER THIS TIME THE TENANT AND HER CARETAKER SON " PACKED UP AND LEFT A HUGE MESS. IRONICALLY THE OTHER SON DID NOT LEAVE WITH THEM. HE IS NOW STAYING IN THE rear storage room AND REFUSES TO LEAVE. ALSO TO BE VINDICTIVE HAS REPORTED THE STORAGE AREA TO THE CITY. I HAVE RECIEVED AN ABATEMENT FROM THEM DEEMING THE STRUCTURE AS AS UNHABITABLE.OF COURSE IT'S A GARAGE. WHAT ARE MY RIGHTS? ALSO THERE HAS BEEN A CONIDERABLE AMOUNT OF TRAFFIC FROM DRUG ADDICTS entering in and out of garage THAT OCCURS DAILY.
 
Sounds like your first step is getting the deadbeat son out of there. The fact that the city has deemed the storage area uninhabitable would seem to be in your favor to have him evicted.
