CLIFFS:
(i live in massachusetts (), currently suspended from high-school until end of the year, when i will be going to another high school *not allowed back to same school*.)
I was alone in class with a teacher (getting make up work)
he demanded an apology for me telling him he needs anger management - in exchange for the work i needed.
i refused.
he got \"ANGRY\" again.
he tried locking me in the classroom.
he clearly presented a dangerous situation to me.
i grabbed the door, forced it open (him resisting), he tried grabbing me, i push him off. then i get out of the classroom - (to safety).
I went to the office to report this incident, but endded up \"suspended until the end of the year, for assaulting a school employee - not allowed to attend the same school next year.\"

(the teacher in question has a well-known reputation in the school for CHALLENGING HIS STUDENTS TO A PHYSICAL FIGHT)

a.The environment provided was in no way safe, as the teacher ASSAULTED ME (physically and emotionally/verbally) I have been

lock me in the classroom and PHYSICALLY RESTRAIN me.Throughout the situation I remained COMPLETELY CALM and in no way

created/implied a threat to me or ANYONE else.

b.I have NOT been supported by the staff at [CITY-NAME HERE] [school-title here] High School in my pursuit of a HIGH LEVEL of achievement and

accomplishment. Many of the people that have had a conversation with me are fully aware of the fact that I wish to one day

own a MCDONALDS fast food chain, including MR. O[ENGLISH TEACHER NAME HERE] whom which I told during a previous peaceful conversation earlier in

the year. During our recent incident, I was told by MR.O[ENGLISH TEACHER NAME HERE] that I would never be competent to reach my goals and own a

MCDONALDS.

c.As a student of [CITY-NAME HERE] [school-title here] High School and a smart citizen, I have been pursuing my education and informing many

of my educators of my life goals. I, along with many other students, have been encouraged to drop out of school and/or participate in an alternative

education program (CSC/GCC/ETC...) multiple times by staff of the school (MR.FAILS, MS. OMALLY, MR. POTTER). And at one

point, I was even told that those were MY ONLY OPTIONS.

Therefore, from my experience I can conclude that [CITY-NAME HERE] Public Schools and their representatives have contradicted their

own mission statement on multiple accounts.The school does not show any effort in actually standing by this statement.

b.I have been denied my right to freedom of speech on multiple accounts during my time at [CITY-NAME HERE] [school-title here] High School.

One one occasion: MR O[ENGLISH TEACHER NAME HERE] had asked the class who they thought was a great person in history, This question being an

opinion - I decided to voice mine, I stated that in my opinion: Adolf Hitler was a great person. . After Class, I was THREATENED that if I made such a comment or stated a similar opinion again, MR O[ENGLISH TEACHER NAME HERE]

would call the JEWISH.... (some lawyer group), The ACLU, and some other anti-hate type of legal group.
He strongly established this threat - EVEN AFTER I EXPLAINED TO HIM WHY I BELIEVE HITLER WAS GREAT. Which was in NO WAY RACIST or ANTI-SEMITIC.

As you can see, NONE of my comments were offensive in any way, neither were my expressions. If anyone WAS offended by my expressions or comments then that was through no fault of MY OWN, as the school failed to teach other cultures\' use of the

United Nations - Universal Declaration of Human Rights - Article 26:

a.Ensuring access to education is a precondition for full realization of the right to education. Without access, it is not possible to guarantee the right to education. The \"in-house\" suspension \"program\" (PROGRAM - as it is not just a room)

violates this right that has been granted to me and every other student of [CITY-NAME HERE] [school-title here] High School as citizens of the

United-Nations-participating-USA.

b.The \"in-house\" room does not provide its students with ANY academic work most of the time, nevertheless EQUVALENT ACADEMIC

WORK. Students that have been sent to in-house are, instead, ordered to walk around the school with a school official whose

otherwise position is unknown to me. The students are forced to stand,sit,wait, or whatever the school official (MR. FAILS)
orders them to do. They are threatened and intimidated into performing various tasks and random \"favors\". They are repeatedly

denied the right to use the bathroom (any medical professional can tell you that such an act is dangerous and unhealthy).

a.Students in the in-house room [see: point #3] are, on a daily basis, subjected to forced physical labor.One of the most

common (daily) tasks of the students\' of the in-house room is to take EVERY chair in the cafeteria and stack them up in

stacks of 3, and then put two stacks on top of EACH table. There is no option but co-operation. In the past, When I refused

this slavery, I was threatened that the accusations to punishment ratios would be taken out of proportion. This proved true,

when I - having trust in JUSTICE and my schools disciplinary handlers, refused the labor - and thus got suspended for (3)

consecutive days on the charge of VERBAL ASSAULT OF A SCHOOL EMPLOYEE (this was later changed, but the classwork was still

lost)
b.Many of the students sent to the in-house suspension program, are never even convicted of their accused crimes, and are
often escorted straight from their classrooms.Therefore, their 13th amendment rights are violated, as they are subjected to SLAVERY - without being duly convicted.

KEVIN O\'[ENGLISH TEACHER NAME HERE] VIOLATED [Chapter 71: Section 37G of MASSACHUSETTS General Laws] by using CORPORAL PUNISHMENT in the form of: intentionally inflicting bodily injury and through the illegal use of restraint, upon pupils.Doors only lock from the outside;
This ONLY makes the situation MORE dangerous, as now the teacher can lock the door - do WHATEVER they want to the student - and NOBODY can get in to save them (unless they happen to have the right key - with them.)
It is my belief that not only did the teacher intend to hold me in the classroom against my will and become violent (he has a history of LITERALLY challenging students to physical fights), but he also thought that he would be able to lock the door and keep potential rescuer\'s out, while he continued with violent actions that are unimaginable to me.

In His statement, MR O[ENGLISH TEACHER NAME HERE] claims that he was locking the door because WE WERE LEAVING THE CLASSROOM and he needs to lock his door (makes sense, with expensive equipment and important documents) However, He goes on to state that he told me to \"sit down\" because we were going to wait IN THE CLASSROOM for someone to come (security - btw, he never even called them.... he just said that in the stor) which, again makes sense by itself, but completely contradicts his previous claim.

EVERY single time I attempt to bring TEACHING INCOMPETENCY\'s and/or VIOLATIONS to the attention of my academy office, I am DISCIPLINED for my
actions. This is completely outrageous and NEVER justified or investigated. When I ASKED a teacher if the reason SHE was

going to talk to (principal) about a test was: \"Why, So you can get fired?\" then I was SUSPENDED for VERBAL ASSAULT OF A SCHOOL

EMPLOYEE. This does not make any sense, as my accusations were NEVER investigated, and I stated a QUESTION - which it is not

possible to threaten asking a question. The FACTS were:

the teacher was letting us watch a movie (of a book, that we still had 2 chapters to read)
We all agreed, because we would get almost equal information out of this movie.
There was to be a test after the movie.
During the movie a student asked to use the bathroom (apropriately) and was NEVER answered - instead HE was \"written up\" and

reported to the office.
As a result, another student made a rude/sexually assaulting comment (never got in trouble) saying something with equal

meaning/insult to and very similar to: \"what are you on your period\". The teacher was outraged and immediately stopped the

film, and told us to read.
The next day (we still had more left to read), but were given the option of taking the test, or taking a ZERO for a grade.
I, (having a very low grade in ENGLISH), did not accept her unfair teaching methods - that prove her incompetentcy. Students

should NOT be tested on material that was never taught. I felt cheated and like I was being set up to fail this class all

year - so I could not take anymore UNFAIR GRADING. I said \"no\", she called the office and got \"MR FAILS\" then he immediately

removed me from class (along with another student - HIM having ABSOLUTELY no reason). MR . FAILS when asked about his

arbitrary removal of students, replied with statements about the BUSH DOCTRINE and the PATRIOT ACT, saying He was a lawyer

and knew what he was talking about. I disagreed as the BUSH DOCTRINE does not apply to the situation. (We were in no way

creating a fear of terrorism)

LAST HEARING:
I was told that witnesses were not allowed when I brought up MR O[ENGLISH TEACHER NAME HERE]S past.

The tape was stopped, and turned over: during the \"hearing\" (which means the writing was stopped - as the same lady was

performing both tasks)

DECISION OF LAST HEARING:
The decision was delayed beyond the allowed 5 days.
The paperwork was INTENTIONALLY dated wrong.
We were denied our right to an answer over the phone - (and told IT MUST BE IN WRITING).
We then waited for the mail to come with the answer and finally realised what was going on.
(the school KNOWS my dad is in jail; and therefore cannot receive certified mail).
They had the letter send to my house with the requirement it be picked up at the post office, so the post office took it and

left a note. MY MOM WAS UNABLE TO pick up the mail, being in the name of MY FATHER ONLY;
ALL OTHER mail has been sent \"To the parents of\" and/or ONLY ME and my MOM.
The note said that ONLY my father could pick up the mail, and ONLY at a certain date.
ON THE LAST DAY to appeal, my mom went to the DURKIN BUILDING and requested an answer,
she was given the paper saying I lost (as predicted), then noticed that it had been dated to (nine) days before, so had we

somehow got the letter, it would have been past the date to appeal. They were attempting to intentionally cause us to miss

the appeal time.

I am not an active student, due to ongoing case, so the school has no business in my personal life and/or myspace profile, until such matters regarding my case are resolved. They did not comply with these facts, by HARRASSING,INTIMIDATING,AND INTERROGATING
current pupil(s) of [CITY-NAME HERE] [school-title here] High School, and FORCING them to login to and taking control of their personal account(s) on myspacelink blocked and by viewing my profile, strictly through the friendship network of the foresaid pupil(s).

The Faculty have repeatedly DEFAMED MY CHARACTER by adding false accusations and/or un- necessary/proved violations/comments/files to my record. They also DISCRIMINATED against my DISABILITIES (as defined under section 504).

I DO have a disability and have been DISCRIMINATED against it many times by the school, through various disciplinary methods

including SUSPENSIONS and IN-SCHOOL SUSPENSIONS or (in-house; SEE POINTS: 3,4).
I have been diagnosed with CAPD (

-- Resists new situations
-- Can be very impulsive or distractable.
-- (Do not understand personal space, therefore do not respect it and
might seem rude or aggressive
Tend to bump or push others, or touch them too often or too hard

pattern of exclusion. Sometimes a school will use a number of short suspensions to keep a student out of school. This is

not legal. Pay attention to how many times the school suspends your child, how long each suspension lasts, and how close

together the suspensions are over time.

If a student has so much trouble getting along that s/he keeps getting suspended, then something is wrong with the IEP. The

school is not doing its job of helping the student to learn. This is a sure sign that the student needs a new behavior

intervention plan.

Before the IDEA, many children with disabilities were kicked out of school. The IDEA protects these students. Now, federal

and state laws have strict rules about removing a student with a disability from school.

you believe they have the right to enforce the USA PATRIOT ACT (and suspend for 3 days based on) against a 16 year old kid, that refused to do his work in class - because the teacher literally NEVER taught the material (and it was a test that was worth most of the grade for the class., I already have trouble in that class - due to a disorder - therefore I did not want to take the risk of failing another year of english -WITH GOOD GRADES IN OTHER CLASSES-). [I was told if i did not comply with demands of manual labor, i would be suspended -if i did, i would get off "easy" - i did not participate in this slavery, and was then suspended for: "Verbal Assault of a school employee"; 3 days out of school] IF you are wondering why i'm the only on that got in trouble, it's because I AM THE ONLY PERSON WILLING TO DEFEND MYSELF, because EVERYONE AGREES WITH ME, but are afraid to speak against the mafia-style (in terms of fairness) school discipline system. but I, am right - therefore have to reason to be afraid, because i strongly believe that I have a good case against the school. I have plenty of people that would testify their experiences at the school.

Have your parents advocate for you at school, or have them consult with a lawyer for you.

By the way, I don't think you accurately described the disability you claim to have.

Well, YES THIS IS THE current PROBLEM. the "randomness" is my past experiences as well as the experiences of other students.

what i am trying to say is, the school breaks multiple laws - on multiple occasions (i am sick of it; especially since it has directly affected me). but what you quoted is my specific current problem. the rest is speaking more generally, i apologize for any confusion i caused you guys, and i appreciate the opinions.

Well I think Irish pretty much hit the nail on the head. Believe me you are not the first high school student to have a beef with a teacher or a school. The citations you provided have little or nothing to do with your problem. One point the Universal Declaration of Human Rights, not a treaty itself, the Declaration was adopted for the purpose of defining the meaning of the words "fundamental freedoms" and "human rights" It has little or nothing to do with U.S law.

I understand the citations are somewhat unrelated, however this is a legal forum and there are multiple legal problems with that school - and it eventually lead to me being kicked out of the school. The entire faculty was against me, and always did what they could to get me in the most trouble possible. They had this problem with me because of my disorder that causes me to seem rude. I cannot help this, and they HAVE been informed multiple times. I brought up the universal declaration of human rights because "the" school denies pupils their right to an education on a daily basis.
