Here is a tough one..Filed Chapter 7 last year, signed a reaffirmation agreement with my 1st mortgage but not my 2nd..it has been over 90 days and my 1st mortgage has actually been sold to another lender. I received a discharge letter in the mail, however I have been told my case is still open due to some asset reviews of an LLC I am part owner in.(I don't really understand how my case is still open after discharge) I am unable to place my home on the market because of this, but am struggling with the payments due to a hardship post filing and increased taxes. My question is do I have any options to invalidate the reaffirmation agreement since my bankruptcy is still open..I am sure I will be foreclosed upon in a few months. Any advice?..what is the likelihood of the 1st mortgage taking legal action if my home does not bring the loan amount on the courthouse steps?
