My husband and I are getting a divorce, and I am going to keep the house, and the mortgage payment debt ($250,000) but I want the house to just be in my name, an no longer in his name. I realize the divorce papers could say that, but it is the bank record that concerns me.

If I do a refinance into my name only, I don't beleive my income alone will qualify for the loan. Even though the divorce will say that I get the house, this concerns me as his name would still be on it.

Can I refinance after the divorce, and only use him as a cosigner? As a cosigner does he have any rights to sell the house? Or get partial payment if I decide to sell it at a later date?

Advice or Other suggestions are welcomed please.
