HELP!Should he have filed wc?

My jurisdiction is: Indiana

My husband is partners with his Uncle doing home remodels. He was at a client's home a couple of weeks ago. The guy did not see that he had arrived. My husband got out of his car and was in the back of the van with the back door up; reaching in to get some tools. The client reversed his car and it pinned my husband between both vehicles. He was rushed to the ER. They did not think anything looked broken, but said we needed to do a follow up. So, he has been laid up and off work. We are trying to work things out with the guys insurance. I thought that my husband should have filed a wc claim. He said he that wc would not touch the case since it was the clients fault. Should he have filed with Workers Comp?
