Lower back injury reoccurance

Good evening, I will try to provide accurate info. on my situation. Back in 2001 in N.C. I injured my back on the job while leaning over the hood of a car and had filed a workers comp. claim. I went through physical therapy and it seemed to provide relief from the pain. The workers comp. called me and said due to the damage to my back I was entitled to receive a lump sum, little did I know that this was a settlement. 1 year later it happened again and the claim was denied through workers comp. and my disability encurred the costs and I was recommended to either have surgery or consider a new career. I moved to Maryland and took a much less physically demanding job and over the years have had flare up but nothing that kept me out of work or unmanagable. Recently a flare up occured and I tried to work through it but while at work I went to reach for something and my back and legs gave out and I hit the ground. I went to the emergency room and consulted a back specialist and he said I need surgery asap from a severe disc herniation. My employer has not mentioned anything about a workers comp. claim and gave me FMLA and STD paperwork. My question is am I entitled to workers comp. benefits even though I took a settlement in another state and since there is a history of a lower back issue?
